Course Description

This course will survey legal issues affecting children in our nation's elementary and secondary schools, with an emphasis on public schools. Topics will include the right to an education (and to a quality education, to the extent that such a right exists); compulsory attendance and school choice; curriculum, religion, and expression; discipline; and educational equity, especially in relation to race, class, and disability. While we will cover some well-settled areas of law, we will also devote attention to policy questions and ideas for legal reform. This is a serial writing course in which students will draft several pieces of legal writing (such as a letter to an opposing counsel, a proposed regulation, and so forth).
