Criminal Procedure II

Course Description
Criminal Procedure II covers the main pretrial stages of criminal proceedings in felony cases: prosecution charging decisions; bail and other forms of pretrial release or detention; preliminary hearings; indicting and investigating grand jury proceedings; joinder and severance of defendants and offenses for trial; double jeopardy; speedy trial; pretrial discovery; prosecution disclosure and preservation of exculpatory evidence; guilty pleas and plea bargaining. The course deals with more day-to-day, "practical" procedure than Criminal Procedure I. The legal materials include rules of procedure and statutes, as well as some constitutional provisions. The class involves traditional case analysis (mainly U.S. Supreme Court cases) but also includes a series of role-play simulations, with each student (in pairs) participating in 3-4 simulated pretrial proceedings, serving as judges, attorneys, and witnesses. Each student will also write 3, 10-15 page papers, with at least 2 being trial court advocacy memoranda in support of or in opposition to pretrial motions.
