Criminal Appellate Procedure

Course Description
This case has two major points of focus - the procedures and rights involved in the appeal of a criminal case; and the effective writing and arguing of an appeal following conviction and sentencing. The course begins with an overview of the appellate process, including issue preservation at trial and the step--by-step of appellate representation (prosecution as well as defense). The role of the appellate courts, as well as of appellate attorneys, is also examined. The second half of the course will involve preparing an appellate brief in a criminal case, working off an actual trial record, followed by oral argument. Students will be graded based upon classroom participation, the writing component, and the oral advocacy.
