Course Description
This course will focus on a broad range of disability laws, regulations and employer benefit offerings, with specific concentration on the Americans with Disabilities Act (ADA), the Family Medical Leave Act, employer sponsored disability plans governed by ERISA, the emergence of Paid Family Leave laws across the country and the implications for employees and employers of all sizes. Topics will include disability types (physical, mental), legal burdens of proof, threshold variance with an examination of disability and employment discrimination, reasonable accommodations under the ADA, the concept of an undue hardships and the interplay of mandated laws and new employee benefits like Parental leave. There will be an emphasis on federal regulations, EEOC guidance, historical and current case law, as well as fundamental insights on employer risk mitigation, regulatory compliance and an in-depth look into the rapidly expanding business of absence management in the private sector.
