Course Description

Although state constitutions receive less attention than the federal constitution, they play an important role in structuring government and establishing individual rights and protections. This course will consider both of these elements in looking at the ways state constitutions have shaped American law. The course will take a comparative approach, both among state constitutions and between the state and federal constitutions. We will look at important recent litigation over issues such as school funding, gerrymandering, reproductive rights, capital punishment and the free exercise of religion. We will also consider structural issues such as how the judicial and executive branches differ under state constitutions and how state constitutions are amended.
