Course Description

Over the last few decades, we have seen a sharp decline in the number of trials, a phenomenon described as “the vanishing trial.” And yet most of our legal education still focuses on litigation, which represents merely one (relatively uncommon) option of a host of ways to resolve legal disputes. These additional options are often referred to as “alternative dispute resolution,” but they
should really be thought of simply as methods of dispute resolution. Of this menu of options, data show that most legal disputes—both criminal and civil—are resolved through negotiation and settlement, which will be the main focus of this course, along with units on mediation and arbitration.
