Course Description

Practitioners tend to be better schooled in the rights and obligations of their clients than they are in the remedies that the law provides (or does not provide) for a violation of those rights or a breach of those obligations. This course aims to right that imbalance. Students should acquire as sophisticated an understanding of the system of remedies as they acquire of the substantive law of torts, contracts, or the constitution, in relation to which remedies is the perfect (and essential) complement. They will also gain an appreciation of the policy underpinnings - social, political, economic, and jurisprudential - of the choice to provide a remedy, or how much of a remedy, for a wrong or a threatened wrong. Topics to be covered include: the basic principle - restoring the aggrieved party to the rightful position; valuing and compensating personal injuries inside and outside the tort system; remedies of buyers and sellers under the UCC; doctrines that limit the scope of liability at the expense of the basic principle; injunctions to prevent or repair harm; structural injunctions to reform institutions; remedies for affronts to personal dignity; the law of restitution; and sovereign immunity and the 11th Amendment.
